Freiberufler vs Gewerbe: the key differences
A Freiberufler works under §18 EStG, in a Katalogberuf (doctors, lawyers, engineers, architects, journalists, translators and similar) or a comparable scientific, artistic, writing, teaching, or educational activity. Everything else is generally a Gewerbe under §15 EStG. Consistent across the sources I checked:
| Freiberufler | Gewerbe | |
|---|---|---|
| Registration | Finanzamt only | Gewerbeamt plus Finanzamt |
| Gewerbesteuer | None | Only above €24,500 profit (individuals, partnerships) |
| IHK membership | No | Yes (fee varies) |
| Bookkeeping | EÜR, regardless of size | EÜR until €800,000 turnover or €80,000 profit, then balance sheet (§141 AO) |
| Forms | Anlage S plus EÜR | Anlage G plus EÜR |
Gewerbesteuer is partly credited against your income tax, so the gap is often smaller than people assume. One source stresses that credit works only if enough income tax is available. The IHK fee, extra paperwork, and the Gewerbesteuer return are the more reliable differences. Ask a Steuerberater to model your numbers.
Subtopic: how to file correctly (the Fragebogen)
Whichever category applies, you must submit the Fragebogen zur steuerlichen Erfassung within one month of starting your activity. Since 2021 it must go through ELSTER, and the Finanzamt doesn’t ask for it automatically. This form is where classification happens. Sources note that the activity description you enter influences the outcome. A vague or trade-like description can lead to a Gewerbe classification, with Gewerbesteuer and IHK duties.
If you’re registered as a Freiberufler and the Finanzamt later reclassifies you (sometimes at an audit), sources describe retroactive Gewerbesteuer and IHK claims for open years. Mixed activities matter too. Two sources cite a BFH tolerance of 3% of total turnover (capped at €24,500) for commercial income inside an otherwise freelance activity, so confirm this with a Steuerberater.
Sources disagree on what to do when unsure. One advises registering a Gewerbe to be safe. Another notes a wrongly registered Gewerbe can be deregistered. A binding ruling (verbindliche Auskunft) or a Steuerberater consultation is the cleaner route.
What AI tools can (and can’t) do
They can: walk you through the Fragebogen in plain language, explain jargon, map answers to the right ELSTER fields, and submit the form. Afterward they apply the matching tax forms and EÜR logic.
They can’t: legally classify your activity or guarantee the Finanzamt agrees. Treat any “result” as a starting point.
The tools
ELSTER (the official portal)
Free, and the only official route. One independent comparison rates it 3.4 and calls it too complex for laypeople, and the Fragebogen’s wording is hard to follow. It covers all filings, including Gewerbesteuer.
Good for: Confident filers who want no extra layer.
Accountable
Accountable offers a free online tool for the Fragebogen that, by its own description, submits through the official ELSTER interface and costs nothing for the registration. Its Taxes plan runs about €29.90 a month in one independent comparison, which lists Gewerbesteuer returns as covered.
Good for: Freelancers who want guided registration and later bookkeeping in one app.
Norman
Norman says it rebuilt the Fragebogen into plain-language questions and submits it for you at no cost. That claim comes from Norman’s own site, so check it directly. One comparison also lists Gewerbesteuer returns as covered.
Good for: Freelancers who want a guided registration and are willing to verify the details first.
Lexware Office’s online Fragebogen tool
Lexware offers its own online tool for the form. The page I found is about a year old, so check that it still exists and works the same way.
Good for: Freelancers already in the Lexware ecosystem.
Quick comparison
| Tool | Fragebogen help | Cost (as reported) | Covers Gewerbesteuer return | Caveat |
|---|---|---|---|---|
| ELSTER | Official form | Free | Yes | Complex for laypeople |
| Accountable | Guided online tool | Registration free; Taxes plan ~€29.90/month | Yes | Provider's own claims |
| Norman | Guided plain-language form | Registration free (own claim) | Yes | Provider's own claims |
| Lexware Office | Online tool | Not confirmed | Not confirmed | Page may be outdated |
Prices change often, so confirm them on each provider’s site.
Which one should you choose?
- Straightforward Katalogberuf and comfortable with forms: ELSTER directly.
- Want plain-language guidance: Accountable or Norman, after verifying current terms.
- Unsure whether your activity is freelance: talk to a Steuerberater first. No tool settles that.
- Already registered and need daily tracking: see our guides to deductible expense tracking and Elster filing.
FAQ
Can I choose to be a Freiberufler?
No. The Finanzamt decides based on your activity. What you tick in the Fragebogen is only a self-assessment.
Do Freiberufler need a Gewerbeanmeldung?
No. Freiberufler register only with the Finanzamt. One source says a Gewerbeanmeldung isn’t even permitted for them.
Can I use EÜR if my profit grows?
Freiberufler always can. Gewerbetreibende must switch to a balance sheet above €800,000 turnover or €80,000 profit, once the Finanzamt notifies them.
Is the Fragebogen required for Kleinunternehmer too?
Yes. It’s also where you state your Kleinunternehmer choice and revenue estimate. For the €25,000 and €100,000 limits, see our Elster guide.
